Potrivit CEDO, prin aceast\u0103 m\u0103sur\u0103 firmele respective au fost \u00eempov\u0103rate \u00een mod necinstit \u015fi private de cercurile lor de cump\u0103r\u0103tori, iar schimbarea a \u00eensemnat, de fapt, crearea monopopului asupra pie\u0163ei privind distribuirii manualor \u015fcolare. Completul de judecat\u0103 a precizat c\u0103 perioada de tranzi\u0163ie prev\u0103zut\u0103 de lege a fost prea scurt\u0103, a \u0163inut doar un an \u015fi jum\u0103tate, iar firmele respective nu au fost solicitate pentru participarea la licita\u0163ia lansat\u0103 de firma de stat K\u00f6nyvt\u00e1rell\u00e1t\u00f3 Nonprofit Kft \u015fi nu au primit nici desp\u0103gubiri \u00een urma pierderilor \u00eenregistate din cauza elimin\u0103rii lor de pe pia\u0163\u0103.CEDO a mai constatat c\u0103 noul sistem nu a adus nici un beneficiu, nici p\u0103rin\u0163ilor \u015fi nici copiilor.<\/p>\n<p>Conform sentin\u0163ei pronun\u0163ate \u00een prima instan\u0163\u0103, autorit\u0103\u0163ile ungare au \u00eenc\u0103lcat astfel prevederile Conven\u0163iei Europeane a Drepturilor Omului privind ap\u0103rarea propriet\u0103\u0163ii private.
